Motion by the appellant to stay all proceedings in the above-entitled action, including discovery, pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, entered December 14, 2016. Separate motion by the defendant-respondent to stay all proceedings involving him in the above-entitled action in the event that the Court grants the appellant's motion.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the appellant's motion is denied; and it is further,
ORDERED that the defendant-respondent's motion is denied as academic.
