An appeal having been taken from the judgment of the Supreme Court, New York County, rendered on or about August 18, 2016, And defendant-appellant via assigned counsel, Seymour W. James, Jr., having moved for an order continuing the stay of execution of sentence, granted by an order of a Justice of this Court on August 22, 2016, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of continuing the stay of execution of sentence pending hearing and determination of the appeal, on condition that the appeal is perfected for the September 2017 Term of this Court.
