DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for leave to prosecute an appeal from an order of the Supreme Court, Nassau County, entered August 25, 2016, as a poor person, for the assignment of counsel, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is denied as premature as the time to perfect the appeal does not expire until May 4, 2017; and it is further,

ORDERED that the motion is otherwise denied.
