| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to enlarge the time to perfect appeals from an order of the Supreme Court, Orange County, dated May 18, 2016, and an amended judgment of the same court dated May 18, 2016, and for poor person relief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal from the order is dismissed, without costs or disbursements, on the ground that the right of direct appeal therefrom terminated upon entry of the judgment in the above-entitled action (see Matter of Aho, 39 NY2d 241); and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeals is granted to the extent that the appellant's time to perfect the appeal from the amended judgment is enlarged until May 5, 2017, the record or appendix and the appellant's brief on that appeal shall be served and filed on or before that date, and that branch of the motion is otherwise denied as academic; and it is further,
ORDERED that the branch of the motion which is for poor person relief is denied.
