DECISION & ORDER ON MOTION

Appeal by Frank Ciolli, doing business as Grimaldi's Pizzeria, from a purported order of the Supreme Court, Richmond County, dated and entered October 24, 2016. By order to show cause dated December 22, 2016, the parties were directed to show cause why the appeal should or should not be dismissed on the ground that there was no order of the Supreme Court, Richmond County, dated and entered October 24, 2016, in the above-entitled action.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 2219).
