Motion by the defendant for leave to prosecute an appeal to this Court from an order of the County Court, Suffolk County, dated June 30, 2016, as a poor person and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied as academic, in light of the decision and order on application of this Court dated January 18, 2017, denying the defendant's application for leave to appeal from the order dated June 30, 2016.
