DECISION & ORDER ON MOTION

Motion by N. Scott Banks, counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Nassau County, rendered June 23, 2015, to be relieved on the ground that the appellant has abandoned the appeal by failing communicate with assigned counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renew upon proper papers, including proof of service upon the appellant at his last known place of residence or, if he is incarcerated, at the institution in which he is confined.
