| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the County Court, Suffolk County, rendered December 16, 2014, to enlarge the time to serve and file a pro se supplemental brief. Application by the appellant pro se to recall and vacate a decision and order on motion of this Court, dated August 25, 2016, which granted his motion for leave to serve and file a supplemental brief and to deem the motion withdrawn.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, the decision and order on motion of this Court dated August 25, 2016, is recalled and vacated, and the appellant's motion for leave to serve and file a supplemental brief is deemed withdrawn; and it is further,
ORDERED that the motion is denied as academic.
