The People of the State of New York, Respondent, v Reginald Herbin, Appellant.

Motion by appellant for leave to serve and file an amended brief on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered May 11, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, appellant's original brief is stricken, and appellant is directed to serve and file an amended appellant's brief within 14 days from the date of this decision and order; and it is further,

ORDERED that respondent, if so advised, may serve and file a respondent's brief within 14 days after service of the amended appellant's brief.
