Appeal from a judgment of conviction of the Justice Court of the Town of Poughkeepsie, Dutchess County, rendered June 18, 2014. By decision and order on motion dated December 8, 2016, an application by appellant for a writ of error coram nobis to extend his time to take an appeal was granted and appellant's time was extended to 30 days from the date of that decision and order on motion. The Justice Court has advised this court that appellant failed to file an affidavit of errors.
Now, on the court's own motion, it is
ORDERED that appellant show cause before this court why the above-entitled appeal should or should not be dismissed as improperly taken (see CPL 460.10 [3]; People v Smith, 27 NY3d 643 [2016]), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before March 17, 2017; and it is further,
ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties' attorneys by regular mail.
