Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Nassau County, entered September 28, 2016, on the ground that it has been rendered academic in light of a pending motion to discontinue the action.

ORDERED that the motion is denied without prejudice to renew after the Supreme Court, Nassau County, determines the motion to discontinue the action.
