ECISION & ORDER ON APPLICATION

Application by the appellants on an appeal from an order of the Supreme Court, Nassau County, dated March 23, 2016, to substitute Ellen Pickus, Stephen Gordon, and Bruce Gordon, as co-executors of the estate of Eli Gordon, for the deceased respondent Eli Gordon, to amend the caption accordingly, and to withdraw the appeal.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted, Ellen Pickus, Stephen Gordon, and Bruce Gordon, as co-executors of the estate of Eli Gordon, are substituted for the deceased respondent Eli Gordon, and the caption is amended accordingly; and it is further,

ORDERED that the appeal is deemed withdrawn, without costs or disbursements.
