Respondent having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Jefferson on December 6, 2016,
Now, upon reading and filing the affirmation of Marcus J. Mastracco, Esq., dated March 6, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the second ordering paragraph of the order of this Court entered February 27, 2017, is hereby amended by deleting the date April 11, 2017, and inserting in its place the April 26, 2017, and
It is further ORDERED that the proceeding is removed from the term of this Court commencing May 15, 2017, and is added to the term of this Court commencing June 19, 2017.
