DECISION & ORDER ON MOTION

Motion by McDonough & McDonough, LLP, and Chris McDonough, Esq., for leave to withdraw as counsel for the respondent in a disciplinary proceeding based upon the allegations of professional misconduct set forth in a verified petition dated December 7, 2015, which was authorized by decision and order on motion of this Court dated April 6, 2016. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 6, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and on or before April 7, 2017, McDonough & McDonough, LLP, and Chris McDonough, Esq., shall serve their client with a copy of this decision and order on motion (1) by email at the respondent's last known email address, and (2) pursuant to CPLR 2103(b)(6) by overnight delivery at the respondent's last known business address, and shall file proof of such service with the Clerk of this Court; and it is further,

ORDERED that no further proceedings shall be taken against the respondent, without leave of the Court, until the expiration of 30 days after service upon the respondent of a copy of this decision and order on motion; and it is further,

ORDERED that the return date of the pending motion by the Grievance Committee for the Tenth Judicial District is adjourned until May 8, 2017, and the respondent shall serve and file papers regarding this motion, if any, on or before that date.
