| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue an appeal from an order of the Supreme Court, Westchester County, dated October 11, 2013, which was determined by a decision and order of this Court dated April 29, 2015, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for reargument is granted to the extent that, upon reargument, the decision and order of this Court dated April 29, 2015, is amended by deleting from the third paragraph thereof the words "May 2010" and substituting therefor the words "May 2013"; and it is further,
ORDERED that the motion is otherwise denied.
