| DECISION & ORDER ON MOTION |
Motion by the petitioner-respondent to dismiss an appeal from a decree of the Surrogate's Court, Rockland County, dated December 13, 2016, for failure to comply with CPLR 5525. Cross motion by the objectant-appellant pursuant to CPLR 2004 to extend the time to order the transcript of the proceedings.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is granted and the objectant-appellant's time to order the transcript of the proceedings is extended until May 1, 2017.
