DECISION & ORDER ON MOTION

Motion by Carlos A. Pascual pursuant to CPL 460.30 for an extension of time to take an appeal from an order of the Supreme Court, Suffolk County, dated February 22, 2016, and for poor person relief and the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to extend the time to take the appeal is denied without prejudice to serving and filing a notice of appeal in accordance with CPLR 5513; and it is further,

ORDERED that the branch of the motion which is for poor person relief and the assignment of counsel is denied without prejudice to renew the motion after the notice of appeal has been served and filed in accordance with CPLR 5513.
