It is Ordered that the respondent-tenant's motion which seeks to stay the enforcement of the final judgment and warrant of eviction, is granted on condition that: 1) respondent-tenant perfects her appeal by no later than the October 2017 term - the filing deadline for which is August 9, 2017; 2) respondent-tenant continues to pay accruing use and occupancy in the amount reserved in the most recent lease agreement, on or before each subsequent rental due date, without prejudice. In the event of respondent-tenant's failure to comply with the foregoing conditions, petitioner-landlord may move on five days' notice, for an order dismissing the appeal.
