| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to serve and file a reply brief on an appeal from a judgment of the Supreme Court, Nassau County, dated February 19, 2016, and for leave to supplement the record to include an opinion and order of the United States District Court for the Eastern District of New York dated November 3, 2016, in an action entitled Cohen v Potenza, under docket no. 15-CV-3825.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is granted, the appellant's time to serve and file a reply brief is enlarged until April 18, 2017, and the reply brief shall be served and filed on or before that date.
ORDERED that the branch of the motion which is for leave to supplement the record is denied.
