DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated September 25, 2015, to extend the time to comply with a decision and order on motion of this Court dated January 27, 2017, which denied the respondent's motion to dismiss the appeal on condition that the appellant serve and file a replacement record and replacement brief on or before February 27, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and on or before May 4, 2017, the appellant shall serve and file (1) a replacement record that contains all of the papers filed in connection with the motion that was determined by the order dated September 25, 2015, and does not contain papers filed in connection with motions that were not determined by the order dated September 25, 2015, and (2) a replacement appellant's brief limited to issues concerning the order dated September 25, 2015, and that does not refer to matter dehors the record; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until June 5, 2017, and the respondent's brief shall be served and filed on or before that date.
