Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated November 19, 2015, pursuant to CPLR 5518 to modify a preliminary injunction contained in that order. Cross motion by the respondent to dismiss the appeal on the ground that the order is not appealable either as of right or by permission.
