It is Ordered that motion & cross motion are consolidated for disposition.

It is further Ordered that respondent-tenant's motion which seeks to dismiss appeal (Milin, J.), dated Apr. 26, 2016, is denied.

It is also further Ordered that landlord-appellant's motion which seeks to enlarge the time to perfect its appeal is granted, and the appeal shall be perfected within 60 days after Civil Court, New York County, decides landlord-appellant's motion for renewal and reargument, pending sub judice since July 11, 2016. In the event of landlord-appellant's failure to comply with the foregoing condition, tenant-respondent may move on five days' notice, for an order dismissing the appeal.
