| DECISION & ORDER ON MOTION |
Motion by the defendant-appellant to stay the sale or encumberance of the marital residence, as well as to stay the sale or disposal of the contents of the marital residence, pending hearing and determination of appeals from two orders of the Supreme Court, Rockland County, dated July 17, 2015, and November 13, 2015, respectively.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeal by the nonparty-appellant is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.8[e]) and prior order of this Court; and it is further,
ORDERED that the motion is denied.
