ORDER TO SHOW CAUSE

Appeal by Joseph Gordon and Yael Gordon from an order of Supreme Court, Kings County, dated November 5, 2014. The appeal was perfected on December 14, 2015, and the respondent filed a brief on February 16, 2016. By order of the Supreme Court, Kings County, dated May 4, 2016, the above-entitled action was discontinued.

Now, on the Court's own motion, it is

ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be entered dismissing the above-entitled appeal on the ground that the appeal has been rendered academic by filing an affidavit or affirmation on that issue with the Clerk of this Court, and by serving a copy of the same on each other, on or before May 3, 2017; and it is further,

ORDERED that the Clerk of this Court, or her designee, shall serve a copy of this order to show cause on the parties by regular mail.
