Motion by the appellant to recall and vacate so much of a decision and order on motion of this Court dated January 10, 2017, as dismissed an appeal from an order of the Supreme Court, Kings County, dated September 7, 2011, for leave to appeal to this Court from the order dated September 7, 2011, for poor person relief, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
