Petitioner-respondent having cross-moved to expedite the appeal and to vacate the stay granted by order of the Hon. John V. Centra, dated August 29, 2016,

Now, upon reading and filing the affirmation of Roger B. Williams, Esq., dated March 27, 2017, the notices of motion and cross motion with proof of service thereof, the affirmation of Lisa DiPoala Haber, Esq., dated April 6, 2017, the affirmation of Graham Seiter, Esq., dated April 6, 2017, and the affidavit of Glenn A. Gartner, filed April 7, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to reschedule the appeal is granted, and the appeal is removed from the calender for the term of Court commencing September 5, 2017, and added to the calendar for the term of Court commencing October 16, 2017, and

It is further ORDERED that the cross motion insofar as it seeks to expedite the appeal is denied, and

It is further ORDERED that the cross motion insofar as it seeks to vacate the stay is granted, and the order of the Hon. John V. Centra, dated August 29, 2016, is hereby vacated.
