Plaintiff having moved for permission to file a 120-page brief and for an extension of time to perfect the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on June 15, 2016, and defendant having cross-moved for permission to exceed the 70-page restriction on his brief, for an extension of time to perfect the cross appeal, and for an extension of time to file and serve a respondent's brief,

Now, upon reading and filing the affirmation of Linda M. Campbell, Esq., dated March 20, 2017, the statement and affirmation of Jon W. Brenizer, Esq., dated March 23, 2017, and March 28, 2017, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion and cross motion are denied insofar as they seek to exceed the 70-page restriction for briefs, and

It is further ORDERED that the motion and cross are granted insofar as they seek an extension of time to perfect the appeal and cross appeal, and the appellant and cross appellant shall perfect their appeals on or before June 9, 2017, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order, and

It is further ORDERED that defendant's cross motion is otherwise denied as premature.
