Motion by appellant, in effect, to vacate a decision and order on motion of this court dated January 4, 2017, which, on the court's own motion, struck the above-captioned appeals from an order of the Civil Court of the City of New York, Kings County, entered May 22, 2015, from the appeals calendar and the general calendar on the ground that the transcript of the oral argument that was held on May 22, 2015 was required for the appeals to be properly perfected and had not been settled.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied.
It is noted that this court's decision and order on motion dated May 24, 2016 held only that the transcript of the proceedings on March 20, 2015 was not a necessary part of the record.
