U.S. Bank National Association, as trustee, on behalf of the holders of CSMC Mortgage-Backed Pass-Through Certificates, Series 2007-1, respondent, v Marie Auguste, also known as Marie M. Auguste, et al., defendants; Charlotin and Bushwick Groupe, LLC, nonparty-appellant. (Index No. 506979/14)
| ORDER TO SHOW CAUSE |
Appeals by the nonparty Charlotin and Bushwick Groupe, LLC, from two orders of the Supreme Court, Kings County, both dated January 3, 2017.
On the Court's own motion, it is
ORDERED that Marie Auguste, also known as Marie M. Auguste is directed to show cause before this Court, why an order should or should not be made and entered dismissing the appeals by Charlotin and Bushwick Groupe, LLC, on the ground that the notice of appeal does not comply with CPLR 5515 as Charlotin and Bushwick Groupe, LLC, is not a proper appellant, by filing an affidavit or affirmation on that issue with the Clerk of this Court on or before May 15, 2017, and by serving one copy of the same on the respondent or, if so advised, by making a motion to correct the notice of appeal to reflect that Marie Auguste, also known as Marie M. Auguste, is the proper appellant (see Matter of Tagliaferri, 1 NY3d 605; CPLR 2001), on or before May 15, 2017; and it is further, ORDERED that the Clerk of this Court, or her designee, shall serve a copy of this order to show cause on the parties to the appeals by regular mail.
ENG, P.J., MASTRO, RIVERA, DILLON and BALKIN, JJ., concur.
