Motion for leave to prosecute an appeal and cross appeal from a judgment of the Supreme Court, Westchester County, entered August 5, 2016, on the appendices and briefs filed in connection with an appeal from a decision and order (one paper) of the same court dated February 29, 2016, for leave to serve and file a supplemental joint appendix and supplemental briefs, and, in effect, to consolidate the appeal from the decision and order with the appeal and cross appeal from the judgment.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the appeal from the decision and order is consolidated with the appeal and cross appeal from the judgment, on or before May 19, 2017, G. B. K. shall serve and file a supplemental joint appendix containing the judgment, the notice of appeal and the notice of cross appeal from the judgment, and any other additional portions of the record that are necessary to consider the issues raised on the appeal and cross appeal from the judgment, as well as a supplemental brief raising issues that were not raised in the briefs filed on the appeal from the decision and order dated February 29, 2016, on or before June 19, 2017, K. A. K. shall serve and file a supplemental brief containing, inter alia, her points of argument on the cross appeal from the judgment (see 22 NYCRR 670.8[c][3]), on or before July 19, 2017, G. B. K. shall serve and file a supplemental reply brief, if any, and on or before August 3, 2017, K. A. K. shall serve and file a supplemental reply brief, if any.
