| DECISION & ORDER ON MOTION |
Motion by Benjamin Bernstein and Lynne Bernstein to enlarge the record on an appeal from an order and judgment (one paper) of the Supreme Court, Putnam County, dated December 29, 2016, and a proceeding pursuant to CPLR article 78, which was transferred to this Court by the order and judgment dated December 29, 2016, to include certified transcripts of certain public hearings and to direct the respondents/respondents to reimburse them for the costs of the transcripts.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the record is denied as unnecessary as the subject transcripts are properly part of the record; and it is further,
ORDERED that the motion is otherwise denied.
