2016-04884 HSBC Bank USA, etc., respondent, v Eric King, et al., defendants, Michelle Walden, appellant. (Index No. 18348/08)
| DECISION & ORDER ON MOTION |
Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from a purported order of the Supreme Court, Queens County, dated November 18, 2015, and entered March 24, 2016. By order to show cause dated November 9, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action on the ground that there was no order of the Supreme Court, Queens County, dated November 18, 2015, and entered March 24, 2016, in the above-entitled action.
Now, upon the order to show cause and no papers having been filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 2219); and it is further,
ORDERED that the application is denied as academic.
ENG, P.J., AUSTIN, BARROS and BRATHWAITE NELSON, JJ., concur.
