DECISION & ORDER ON MOTION

Appeal by Skiboky S. Stora from an order of the Supreme Court, Kings County (IDV Part), dated July 28, 2016. Pursuant to a scheduling order of this Court dated August 25, 2016, the appeal in the above-entitled proceeding was to be perfected within 60 days after the receipt by the appellant of the transcripts of the minutes of the proceedings which occurred in the Supreme Court. The appellant advised the Court that the transcripts were received and the appeal was due to be perfected on or before March 6, 2017. The appellant has not yet perfected the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order dated August 25, 2016, issued pursuant to § 670.4(a)(2) of the rules of this Court (22 NYCRR 670.4[a][2]).
