| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Queens County, entered May 13, 2015, to extend the time to comply with a decision and order on motion of this Court dated January 9, 2017, which, upon deeming the notice of appeal to be a premature notice of appeal from the judgment, directed him serve and file a supplemental record containing the judgment on or before January 30, 2017. Cross motion by the respondent to dismiss the appeal for failure to comply with the decision and order on motion of this Court dated January 9, 2017.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and on or before May 18, 2017, the appellant shall serve and file the supplemental record containing the judgment; and it is further,
ORDERED that the cross motion is denied.
