| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss appeals from three orders of the Supreme Court, Queens County, two dated June 19, 2015, and one dated November 30, 2015, on the ground that appellant failed to comply with a decision and order on motion of this Court dated June 27, 2016, which denied the branch of the respondent's motion which was to dismiss the appeals on the ground that the record is inadequate, on condition that the appellant serve and file a supplemental record containing certain material, on or before a date certain. Separate motion by the appellant, inter alia, for a preliminary injunction, for compensatory damages, and to appoint a trustee.
Upon the papers filed in support of the respondent's motion and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the appellant's motion and the papers filed in opposition thereto, it is
ORDERED that the respondent's motion is granted and the appeals are dismissed, without costs or disbursements; and it is further,
ORDERED that the appellant's motion is denied as academic; and it is further,
ORDERED that the branch of the respondent's prior motion which was to dismiss the appeals from the orders dated June 19, 2015, as untimely taken, which was held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof by the decision and order on motion of this Court dated June 27, 2016, is denied as academic.
