| DECISION & ORDER ON MOTION |
Motion by Kathleen Higgins, inventory attorney with respect to the above-entitled matter appointed by decision and order on motion of this Court dated April 4, 2014, for leave to deliver certain records to the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts, for authorization to make arrangements for the destruction of any files contemplated by the court-ordered inventory that remain unclaimed, and to be discharged. Kenneth J. Gellerman was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 1, 1985. By opinion and order of this Court dated November 26, 2014, Mr. Gellerman was disbarred and his name was stricken from the roll of attorneys and counselors-at-law (see Matter of Gellerman, 124 AD3d 62).
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that Kathleen Higgins is directed to deliver all banking and bookkeeping records in her possession as inventory attorney in the above-entitled matter, including but not limited to an uncashed 2003 check payable to Gellerman and a client, an uncashed 2012 check payable by Gellerman, a New York State Workers' Compensation invoice, and a file for an action entitled Strawder v Ba, to the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts; and it is further,
ORDERED that Kathleen Higgins is authorized to arrange for the destruction of any unclaimed files under the guidance of Robert P. Guido, Executive Director for Attorney Matters, and shall provide the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts with a record of all files inventoried; and it is further,
ORDERED that upon completion of the foregoing, the motion is granted and Kathleen Higgins is discharged as inventory attorney in the above-entitled matter.
