It is Ordered that motion & cross motion are consolidated for disposition.

It is further Ordered that respondent-tenant's motion seeking to dismiss appeal is denied.

It is also further Ordered that the petitioner-appellant's cross-motion seeking an enlargement of time to perfect the appeal is granted on condition that petitioner-appellant perfects its appeal by no later than the October 2017 term. The filing deadline is August 9, 2017. In the event of petitioner-appellant's failure to comply with the foregoing condition, respondent-tenant may move, on five days notice, for an order dismissing the appeal.
