It is Ordered that the defendant-respondent's motion which seeks to dismiss the appeal and release funds on deposit with the Finance Administrator of the City of New York is denied. Plaintiff-appellant shall perfect its appeal by no later than the October 2017 term - the filing deadline for which is August 9, 2017. In the event of plaintiff-appellant's failure to comply with the foregoing condition, defendant-respondent may move, on five days' notice, for an order dismissing the appeal.
