Appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on November 3, 2016,
Now, upon reading and filing the affidavits of William Dean sworn to March 22, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks poor person relief is denied on the ground that the facts as set forth by appellant fail to demonstrate merit to the appeal.
