Motion by respondent on an appeal from an order of the Justice Court of the Town of North Castle, Westchester County, dated August 18, 2016 and a final judgment of the same court entered September 16, 2016, in effect, to vacate a decision and order on motion of this court dated January 19, 2017, which, on the court's own motion, held the appeal and a motion by appellant for a stay in abeyance pending the substitution of a personal representative for the deceased occupant Gertrude Moses.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied.
