Respondents-appellants having moved for permission to proceed as poor persons on the appeals taken herein from an order of the Family Court, Cattaraugus County, entered in the Office of the Clerk of said Court on November 10, 2016,
Now, upon reading and filing the affidavit of Jeremy S. and Michelle M., sworn to March 7, 2017, the affirmation of David J. Pajak, Esq., dated April 19, 2017, the notice of motion with proof of service thereof, and the affirmation of Thomas C. Brady, Esq., dated April 26, 2017, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks permission for appellant Michelle M. to proceed as a poor person is granted, and
It is further ORDERED that the motion insofar as it seeks permission for appellant Jeremy S. to proceed as a poor person is denied, and
It is further ORDERED that the Clerk of the Family Court, Cattaraugus County, is hereby directed to provide Michelle M. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based, and
It is further ORDERED that the transcripts, if any, shall be filed with the Clerk of the Family Court, Cattaraugus County, within 30 days of the date of this order, pursuant to Family Court Act § 1121 (7).
