DECISION & ORDER ON MOTION

Motion by Marianne Karas to be relieved as the appellant's assigned counsel on an appeal from a judgment of the Supreme Court, Nassau County, rendered January 22, 2016, which was determined by decision and order of this Court dated February 22, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon resolution of the application made by the movant on behalf of the appellant which is pending in the Court of Appeals for leave to appeal to that Court from the decision and order of this Court dated February 22, 2017.
