| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on an appeal from an order of the Supreme Court, Queens County, dated May 12, 2016, inter alia, to include the trial transcript of certain other proceedings. Cross motion by the respondent to dismiss the appeal on the ground that the brief refers to matter dehors the record, to "release . . . the [a]ppellate [b]ond," and for an award of counsel fees.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the branch of the cross motion which is for an award of counsel fees is denied without prejudice to seeking relief in the Supreme Court, Queens County; and it is further,
ORDERED that the cross motion is otherwise denied.
