Petitioner having moved for an extension of time to file and serve a brief, for permission to proceed as a poor person, and for assignment of counsel on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Orleans on February 27, 2017,

Now, upon reading and filing the affidavits of Sarah Murphy-Sears sworn to May 11, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve a brief is granted to the extent that the third ordering paragraph of the order of this Court entered April 24, 2017, is hereby amended by deleting the date May 15, 2017, and inserting in its place the date June 14, 2017, and

It is further ORDERED that the fourth ordering paragraph of the order of this Court entered April 24, 2017, is hereby amended by deleting the date June 19, 2017, and inserting in its place the date July 19, 2017, and

It is further ORDERED that the motion insofar as it seeks permission to proceed as a poor person is dismissed as unnecessary, and

It is further ORDERED that the motion insofar as it seeks assignment of counsel is denied.
