DECISION & ORDER ON MOTION

Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Nassau County, entered August 18, 2016, for failure to timely perfect. Separate motion by the appellant to enlarge the time to perfect the appeal and for poor person relief. Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motions and the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the appellant's motion which is to enlarge the time to perfect the appeal and the application for that relief are granted, the appellant's time to perfect the appeal is enlarged until August 7, 2017, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date; and it is further,

ORDERED that the appellant's motion is otherwise denied; and it is further,

ORDERED that the respondent's motion is denied.
