DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by Volf Z. Birman for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Birman was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 14, 1999, under the name Volf Zev Birman. By opinion and order on motion dated April 12, 2004, this Court suspended Mr. Birman from the practice of law for a period of one year, commencing May 12, 2004, based on his conviction of a misdemeanor (Matter of Birman, 7 AD3d 11), under Appellate Division Docket No. 2002-06378. By opinion and order of this Court dated September 26, 2006, Mr. Birman was disbarred, effective immediately (Matter of Birman, 34 AD3d 16), under Appellate Division Docket No. 2004-03445. By decision and order on motion dated February 20, 2007, Mr. Birman's motion to reargue the opinion and order dated September 26, 2006, was denied. By decision and order on motion of this Court dated May 5, 2015, Mr. Birman's first motion for reinstatement was denied.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied.

We find that Volf Z. Birman does not demonstrate the requisite fitness and character to practice law.
