Motion by the appellant in both actions to consolidate appeals from two orders of the Supreme Court, Queens County, dated May 29, 2015, and July 13, 2016, respectively. Cross motion by the respondent in Action No. 2, to dismiss the appeal from the order dated July 13, 2016, as untimely taken.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the cross motion is granted and the appeals from the order dated July 13, 2016, in Action No. 2 is dismissed, without costs or disbursements (see CPLR 5513[a]); and it is further,
ORDERED that the motion is denied as academic.
