DECISION & ORDER ON MOTION

Motion by the appellant for poor person relief on an appeal from judgment of the Supreme Court, Nassau County, rendered June 6, 2016, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto; it is

ORDERED that the branch of the motion which is for poor person relief is denied with leave to renew upon proper papers, including the appellant's affidavit setting forth the value of the appellant's pension and the amount of any payments received by the appellant from the pension, as well as the value of any other accounts or assets, and whether there is any impediment to withdrawing money from those accounts; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged, and retained counsel shall prosecute the appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
