| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated May 13, 2015, to enlarge the record to include the transcript of the grand jury proceedings and to be furnished with a copy of the transcript.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the record to include the transcript of the grand jury minutes is denied as unnecessary; and it is further,
ORDERED that the branch of the motion which is to furnish assigned counsel with a copy of the transcript of the grand jury proceedings is granted to the extent that on or before July 12, 2017, the District Attorney shall file the transcript of the grand jury proceedings, under seal, with the Clerk of this Court, for in camera review by the panel of Justices assigned to hear the appeal, and the transcript shall remained sealed upon delivery.
