Appeal from a judgment of conviction of the Justice Court of the Town of Stony Point, Rockland County, rendered October 23, 2014. By decision and order on application dated December 29, 2016, appellant's application for a writ of error coram nobis for an extension of time to file an affidavit of errors was granted and appellant's time to file the affidavit was extended 30 days from the date of the decision and order on application. This court has been advised that no affidavit of errors was filed.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed (see People v Smith, 27 NY3d 643 [2016]).
